General Terms Of Fame Games Membership Applicable To All Artists Who Have Uploaded Songs To The Fame Games System.
Upon registering as an artist within the MMI / Fame Games system you are entering an organization whose primary purpose is to help you find recognition on the international music market, not only by providing you with a high-quality song evaluation system which can help you to produce better music, but also by providing you with vast exposure on network radio and on the web (and in forseeable future through other media, e.g. television, concerts, video, etc), as well as active, direct showcases of the best music received by MMI / Fame Games to music and entertainment industry insiders, specialists and companies.
The MMI / Fame Games system aims to help you make your music a commercial success. This includes helping you find and structure the best possible deals, where your earning potential is the highest it can be.
Upon submitting your music to Fame Games, you are entering a fair and potentially mututally advantageous relationship, particularly in the event if MMI / Fame Games contributes to your eventual success.
In consideration of the above MMI / Fame Games wishes to make clear the terms and conditions applicable to all participating artists, as follows:
By uploading your track to Fame Games, you grant MMI a non-exclusive right to play and digitally distribute your song as a royalty-free promotional sample on any of its Fame Games shows and affiliated radio stations as well as to any interested professional parties who would utilize these samples for the sole purpose of promoting you, incresing your fan-base and hopefully finding a deal for you (e.g. label, publisher, etc).
All song uploads to the Fame Games website are FREE. There is no charge for joining or uploading songs to the Fame Games website.
Songs aired on Fame Games Radio may be playlisted by any of the affiliate radio stations within the broadcast network (Envision Radio Networks and/or DialGlobal Radio Networks). In the event that they should be selected for regular rotational airplay (as opposed to non-rotational promotional song demonstrations) by such affiliated stations, all standard royalty considerations will apply, and shall be accounted by the relevant radio station in a standard manner.
It is understood that your song will be a part of the showcase to the Fame Games community, and is not owned in any way by Fame Games or MMI. Your song may be edited slightly (made shorter at the introduction for example) at the show producers' discretion, for the purposes of giving your song the best first impression in the available time when airing within the show.
While Fame Games aims to play your song on network radio it must be understood that it is impossible to guarantee this for everybody. It must therefore be stated that in order to receive airplay, songs have to pass through the Fame Games qualification system, in accordance with the rules set out on the site. Under normal circumstances, the time it takes for a song to advance through the Fame Games system can vary greatly from weeks to sometimes months, depending on numerous factors - from the artist's individual popularity on the show, to the average scores or fan support each song receives.
It’s very important for us to be sure that you have 100% authortity to place your song on Fame Games Radio, i.e. you are the copyright owner or joint owner with authority over the song.
In the case of cover songs, or songs containing sampled work please be sure to clear the usage of any such samples or derivative music with the respective rights holders. Proof of this may be requested by MMI prior to airing or upon submission.
Performance rights include broadcast and cable television, radio, and any other transmitted performance of a live song.
Permission to publicly perform a song must be obtained directly from an artist or artist's representative.
To obtain a performance right, or to gain representation for your work for the use by others, we suggest you contact the U.S. performance rights societies. Their websites contain search engines that can also assist you in finding publisher information for Synch licensing, print rights, or sample clearances. (See The Harry Fox agency, ASCAP, BMI or SESAC or similar organizations in your territory)
We trust that all the information you provide MMI with regard to your identity and your song is accurate and true. Please ensure that the song credits (e.g. songwriters) include your real name (or your registered artist's name), and not a "screen name" or an unregistered pseudonym.
MMI will not sell or distribute your song without your express permission and authorization.
The MMI / Fame Games service is aimed at providing you/your song with maximum available exposure and opportunities, as represented by the lay and expert listener base of this program.
You have the right to withdraw your songs from Fame Games listings at any time, as long as they are in the "Holding Area," "BackStage" or "GreenRoom" areas, i.e. prior to being aired.
Once your song makes it to any of the broadcast or webcast shows (i.e. Q-Shows, Semifinals or Finals), it can no longer be withdrawn entirely. In the event that you enter a new contractual agreement with a third party, which prohibits you from showcasing your material, the only possibility will be to withdraw the access to the full version of your song, should you request it - but, understandbly, the sample of your song "as it was presented" during the on-air shows can not be removed because it is now part of an archived broadcast and historical record of the show.
The processing time for each submitted song to make it to air is largely a function of the reviewers' and fans' active participation in the song evaluation process. Processing time can also depend on the artist's prior popularity on the show (the most popular artists, i.e. previously known on this show, are typically reviewed quicker).
It will soon be possible to request "express song processing" (we're about to introduce a paid service which will cover this) but note that this will not constitute a guarantee that the song will receive sufficiently high scores to qualify it for the on-air showcases. If the song is deemed of sufficiently high quality, this will be reflected in its score and the song will naturally become eligible for airplay within 3 weeks from submission.
Terms Applicable To All Members Whose Songs Reach the Quarterfinal, Semifinal On-Air Shows
All of the above terms apply, plus the terms that follow.
As stated earlier, one of the key missions of MMI / Fame Games is to provide exposure and opportunities to the best artists who submit their music to the Fame Games System. Those opportunities may include, but not be limited to:
Radio, Film and TV Licensing contracts and opportunities
Regular rotational airplay
Management or consultancy deals
Publishing contracts, catalog-based of single-based
Studio recording and production opportunities
Record deals, for singles or for albums, awarded by major or large independent labels
Concerts and other promotions
MMI / Fame Games promotes the Artist's music not only through its on-air shows, but also during industry showcases, in CD or MP3 form, which MMI / Fame Games produces in limited, non-commercial quantities, as "promotional samples." MMI's representatives may also personally showcase selected music to the company's contacts. In other words, by accepting those terms you grant MMI / Fame Games your non-exclusive permission to do this in order so that MMI / Fame Games can help you become as successful as possible in the music industry.
MMI/Fame Games works very hard to break new ground by helping you, the Independent artist, gain international, network radio play and the opportunity to become an internationally recognized artist. With that we very much hope Fame Games brings you much financial success! We also hold fast to the belief that the opportunities we have worked so hard to create and our website, should be FREE to all unsigned and Independent artists to participate. However, we do incur costs in order to keep the dream alive. In consideration of the above, and by agreeing to these terms, MMI / Fame Games stipulates that should you become financially successful directly resulting from the opportunities we have provided, that a small percentage of your derivative incomes (commissions) be reserved for Fame Games, in order for us to be able to continue these efforts for others in the independent artist community. We can foresee two general scenarios possible:
Reasonable fees or royalties collectible by MMI / Fame Games from the deal-giving company
Reasonable fees or royalties collectible by MMI / Fame Games from the artist
MMI / Fame Games will always endeavor to help the artists broker the best possible deals, on par with or exceeding "industry norms" whenever possible. The rights stipulated in the above scenarios can be, depending on the situation:
Non-exclusive - any deals such as music licensing, concerts or production work, which have a one-off nature (even if the same deal happens numerous times)
Exclusive - any deals such as record or publishing deals, which have a long-term nature and which result in exclusively binding the artist contractually with the contract-issuing company
It will soon be possible for artists to retain MMI on a consultancy basis, which is a new service currently being developed.
The fixed amount or a percentage that MMI / Fame Games may charge in above-stipulated situations shall be subject to individual negotiation with each artist and contract-issuing company, but will always be "marginal" and "reasonable" in the spirit of MMI / Fame Games' stated mission and objectives to help unsigned and independent artists achieve sustained success and financial independence at best possible terms.
Should the Artist not wish to agree to the above terms and conditions, it is still perfectly possible to be featured on Fame Games, but the MMI / Fame Games shall not actively pursue any business opportunities on the Artist's behalf.
This does not mean that the Artist might not be spotted and approached outside of the show, only that MMI / Fame Games will not initiate any such contacts.
Terms Applicable To All Members Whose Songs Reach the Final Stages On-Air Show
All of the above terms apply, plus the terms that follow.
When a song reaches the Fame Games Final, it is automatically being evaluated by MMI / Fame Games- affiliated music industry contacts and companies. While nothing may happen as a result of this high-level exposure, chances are increasingle good that a deal may be put to the artist (e.g. publishing, recording, licensing, etc)
In the event this happens, the artist agrees that MMI / Fame Games shall be their sole agent for the duration of the negotiation that may ensue with the given third party, of which the artist will be duly informed, and a subsequent deal as outlined above shall be authorized.
